On 03 April, KwikChex received a letter from solicitors Clarke Willmott, advising that they had been instructed to challenge online content KwikChex published about their client, Seasons Holidays, under UK defamation laws.
The article that was objected to was titled ‘Devastated – vulnerable investors express their dismay over the failed promises of Seasons Holidays’ and can be viewed on the Timeshare Assistance website by clicking here.

Notably, Clarke Willmott sought to keep this action secret by marking the correspondence ‘Private and Confidential – Not For Publication’.
In addition to responding robustly, KwikChex does not accept that this matter should be suppressed, and this corresponds with advice given by the Solicitors Regulation Authority concerning allegations of defamation, which states – “Telling you or indicating that there will be adverse consequences if you tell anyone else about the correspondence they have sent you. This can include labelling correspondence with ‘strictly private and confidential’, ‘not for publication’, ‘private and confidential’ or ‘without prejudice’ with the aim of misleading you into believing that if you tell anyone about the correspondence, there will be adverse consequences.”
KwikChex has previously faced threats of defamation from businesses we have highlighted as having genuine concerns about (some of which have even subsequently been successfully prosecuted), but this has never deterred us from raising genuine concerns and assisting consumers. All previous threats of this nature came to nothing. Seasons Holidays customers are currently taking several actions, and KwikChex is assisting those with concerns while providing the relevant facts and will continue to do so.
